Usually yes — refusing to appear rarely helps and can itself justify coercive steps. But speak to an advocate first, understand what is being alleged, and do not sign anything you have not read.
Can I get bail if I have not been arrested?
Yes. That is anticipatory bail — protection granted before arrest, and it is applied for exactly because the arrest has not happened yet.
How long does a bail application take?
An application can often be filed within a day of receiving the papers. Listing and hearing depend on the court, but urgent matters can and do get heard quickly.
The complaint against me is really a business dispute. Can it be stopped?
Sometimes. Where an FIR is a civil dispute dressed as a crime, a petition to quash it can be moved in the High Court. Whether it will succeed depends on what the FIR actually alleges.
My bank account has been frozen for someone else’s fraud. What now?
Gather every document showing that the transaction into your account was genuine, and act quickly. The freeze is challengeable, but only with the paperwork.
Will you tell me my case is weak?
Yes. You will be told at the first meeting what can realistically be achieved. An advocate who promises an outcome in a criminal case is not being straight with you.
